expand    How to deal with an employee who is absent without leave for more than two consecutive working days?
  1. For an employee under the scope of the Employment Act 1955, invoke section 15(2) of Employment Act for breach of contract due to absence for more than two consecutive working days without prior leave from the employer without reasonable excuse. The employee may be terminated under section 13(2) of the Act if the reply to the show-cause letter to him is not acceptable.
  2. For an employee outside the scope of the Employment Act 1955, absence without leave for one day or more is breach of contract of service and disciplinary action may be taken which may lead to dismissal. (Refer to Industrial Court Award No. 270/1996 between Advanced Point Sdn. Bhd. Allson Kelana Resort, Seremban v Sarina Teh Rahman Khan)
